Legal actions, organizational and technical activities of the owner and the enterprise operating hazardous production facility associated with the process of industrial safety expertise and the expert organization are considered in the article. It is shown that their current attitude to industrial safety expertise and expert organization, when all the responsibility for safe operation of technical devices during the period assigned by the expert for safe operation life of technical devices, is imposed only on the expert, reduces the quality of industrial safety expertise and has no perspectives of changing the situation for the better. When executing contractual relations with the expert organization, the owner and the enterprise operating hazardous production facility are the strong point and take advantage of their inequitable conduct violating clause 4 of Article 1 of the Civil Code of the Russian Federation. Expert organization is in complete forced financial dependence on the owner and the enterprise operating hazardous production facility. When preparing technical devices for technical diagnostics, the owner and the enterprise operating hazardous production facility commit violations that reduce the quality of industrial safety expertise and require additional costs from the expert organization that are not considered in the contract for conducting industrial safety expertise. It is proposed to replace industrial safety expertise with two-stage process for the assessment of technical devices integrity. Before making changes to the current process of industrial safety expertise, it is proposed that the responsible owner and the enterprise operating hazardous production facility shall be defined by the regulatory document for safe operation of technical devices within the time period after the expiration of the life set by the expert before the expiry date required by the owner of hazardous production facility. To do this, in the expert review of industrial safety it is required to specify two life periods of technical devices safe operation: assigned by the expert and established by the owner of hazardous production facility.
