Reformation of the System of Granting Guarantees and Compensations to the Employees Involved in Hard Labour, Works with Harmful and (or) Hazardous Working Conditions

Annotation:

The scientific view on innovations and planned changes in approaches to ensuring safety and labor protection in the Republic of Kazakhstan is presented. These changes are caused by the transition to management of occupational risks at the plant, qualitative training of the personnel responsible for safety and labor protection at the plant, and obtaining reliable information on the working conditions of the employees. Also reflected are the results of activity of the scientific and research institute on the issues of safety and labor protection. The current mechanism for granting privileges and guarantees to the employees engaged in harmful and (or) hazardous working conditions is considered, and an assessment is made in terms of its compliance with the up-to-date requirements and international codes. Statistical data are provided on financial costs of employers for guarantee provision and compensation to employees for work in harmful and (or) hazardous conditions.
The methods are proposed that provide for a transition from the formal «list» approach on granting benefits and guarantees to the approach that takes into account only the actual working conditions at the the workplace. This, on the one hand, will solve objectively as maximum as possible the issue on the need in compensating the specific worker in a specific workplace for work in harmful and (or) hazardous conditions, and on the other hand — encourage the employers to invest in improving the working conditions in order to optimize their expences.
The importance is shown with regards to certification of production facilities on working conditions in granting benefits and compensations for harmful and (or) hazardous working conditions, and enhance the requirements for specialized organizations.
Approaches to ensuring safety of production and reducing all types of expences associated with unfavorable working conditions based on the identification, assessment and control of occupational risks are analyzed in the Article. At the same time the issues are considered related to the improvement of the system of statistical reporting and accounting of the employees involved in harmful and (or) hazardrous working conditions, as well as knowledge testing of managers and other employees of the organizations responsible for ensuring safety and labor protection.
